my 19 year old son was mandated to a 6 week mandatory course.at damart, in the call center ,he has phoned demart asking if he was off tomorrow bank holiday Monday,and was told he would still have to come in and do his shift. even though its over an hour on the bus and not sure what time buses are on bank holidays, as he needs to catch 2 buses. can they make him work for free on bank holidays ?

Hi london, sorry to hear this. If it is true that they can then I strongly disagree with it but the way things are now it is probably likely and they will say something such as higher expected calls during this period (as paid staff will be on holiday and they will have a shortage).

There isn't much time for anybody else to reply or for you to get hold of a manager on a Sunday evening before tomorrow so it might be a case of having to set off even earlier and work harder than usual but I would mention this also if it means difficulties on the homeward bound journey. Expect Sunday service - I have had a few relatives work on public transport and that is pretty much a given - also cover yourself by checking on line timetables as sunday service might well not have a bus/train running that route then there is no way you could get there other than a taxi which I assume would be extortionate and beyond your son's means being unwaged.

He could still offer to come in if someone can give him a lift which puts the ball in their court. Keep a record of all names dealt with, times etc and if discovering they have broken some form of employment law then start a complaints procedure although this may well go against your son for any time he is still working there during such an action.

I have extensive experience working in the voluntary sector, a lot has changed in the last several years for the worse to the point I don't do it (unless mandated of course) but I have never been told I had to go in on a bank holiday and a lot of mine was with the NHS.

Damart seem like a very curious company to me. They have been involved in various charity activity so I find it strange that they should dictate somebody works on a bank holiday. This just does not seem to match up consistently. My gut says there is whiff of self righeousness about them. I haven't read in depth about them though. Anyway I think it might be useful to speak to the CAB at some point if that is convenient (a visit to mine has to be serious because it can take a couple of hours in the waiting room).

Maybe of more specific help though, I read on the acas site something about a 'written voluntary agreement'.

You may have to contact them to get more info but the one occasion I spoke to them on the phone they were very helpful. I guess I have had something like an agreement in the past, certainly had supervised placements with periodical appraisals and if I had to work a bank holiday without pay then I reckon that would be somewhere near the top of my list of things to address.

Most places public transport slows down after 6 PM even on a normal weekday and it is simple enough to calculate from the times distance you have given that this could be a potential problem on the connection for the homebound journey if not the first leg of it. That word 'reasonable' springs to mind once again. Say your son finishes work just after a bus leaves around 5:15 and the next one is in two hours after 7pm which misses the connection back home with a similar wait for the next bus and you could be looking at getting home well after 9pm which is utterly ridiculous for any day never mind a bank holiday.

Damart put themselves over as engaging with staff, I would love to hear them try and BS their way out of a scenario like that. Not exactly encouraging for workplace relations.

he says hes not going in. hes still in bed as i type this. he says he will go tomorrow ,as usual, cant see him getting a sanction for blobbing bank holiday. but who knows these days.

I note from my wall calendar that there is another Monday bank holiday looming on the 28th May (two weeks from today) so your son should tell them he won`t manage in on that day due to another appointment. ANY appointment! Dental check up? GP visit? Assisting a friend to hospital? Stomach sickness/vomiting....


If they want to see proof of this, he could ask his GP for a fit note to cover him. I hate these bank holidays as they mess with my mind. I think it`s a Sunday rather than a Monday! But seriously, be prepared.

When I lived in Wales, ( South Wales Valleys )There was No Public Transport/Bus service at all on Sundays or Bank Holidays,
The one day you could go out and No Transport :(
So Working unless very local would be a non-Starter.

Yes Paul-UB40, if there are no buses being run that get this guy there and back then it will be seen as an unreasonable request for them to expect anyone to attend.

If there are buses that happen to run in this particular persons area Id almost certainly do a sicky as these kind of places have been known to lay on trans[port if its a significant cash winner for them,they just love labour for nothing. :evil:

A charity shop tried this with me when I was on cwp. They wanted me to work on saturdays and bank holidays.
I told them point blank when the jc and cwp offices are shut then I'm not coming in, as if something happens at work placement you will have no-one to tell as their offices are shut.

Out of curiosity, are job centres closed on Bank holidays? I know they open between Christmas and New year on a skeleton staff, but mainly for admin purposes and for anyone who has been sent a letter to attend for other reasons not signing on. Personally, I think bank holidays and public holidays should MEAN holidays for everyone and not just the chosen few who can afford to close for the day. The buses too as the drivers should be given this day off just for resting.
