Yesterday, It took exactly 8 minutes for a judge to decide that my client should be placed in the Support Group after a DWP decision maker determined that she was not entitled to ESA. The judge also recommeded my client should not be reassessed for 2 years.

Clearly, the judge had read the bundle, including my submissions and after the usual introductions the judge handed over to the GP who asked a series of questions that were highly relevant to my client's health conditions and their effects on her functional ability. These were questions that any self-respecting health professional should have asked at the assessment, but they don't! ...and I think we all know why.

Imagine all the stress my client has endured in completing the application form, the ESA50 questionnaire, attending the work capability assessment, attending advice appointments, completing the Mandatory Reconsideration request and raising an appeal.

And in 8 minutes a judge effectively rules that the health professional and the decision maker are idiots. This is Esther McVey in a nutshell.

And to think this goes on every single day for thousands upon thousands of claimants.

I recognise this all too well Spanner. I went through similar with my last fit for work decision and when I finally went to my appeal hearing, the clerk of the court told me the panel had already made a decision ON PAPER before I`d even walked in. When I eventually went in, sat down, the judge introduced himself and the GP sat next to him. I continued to place my paperwork on the desk and he stopped me in my tracks and said not to bother as they had awarded me back my WRAG group component of ESA. I was in there for about three minutes.

These jokers at DWP are getting away with this madness on a daily basis, yet nobody seems to be challenging it? I`ve read online reports from senior judges saying much the same, yet the government are free (it seems) to answer to nobody and continue with this charade.

Madness is exactly what it is, CoD. And in fact, you are correct, there is no accountability for what are essentially legalised criminal acts. I'm thinking abou the chaos and the cost of these crimes in terms of stress for the client. I am but one of thousands of case workers and advisers in the UK who are dealing with these crimes every day. The sheer number of charities and organisations that exist because of these crimes is staggering and the cost of running those charities and organisations is phenomenal, all paid for by the tax payer of course.

Well put Spanner. I know if I have to contact my CAB person again I will be making a contribution to my local CAB for the sterling work they do. I`m well capably of doing a good submission and wording my letters well, but there can be areas that I`m not aware of and that`s where I could fall on my face, so I always run things past CAB just to be sure. It`s all based around untruths and fear and that surely, can`t continue. I can only speak for myself, but people in the WRAG of ESA would be happy to do some volunteering or even a half days work if DWP would accept we have disabling conditions that don`t allow us to be `normal` jobseekers, yet their main aim seems just to be to get the figures down and get us all signing on. Which back-fires on them because a high percentage of people can`t manage the conditionality UC brings. It`s like facing an onslaught of intrusion and feeling incapable of being in control sometimes. I have chronic pain problems and I`m not supposed to be exposed to stress, yet here I am in the WRAG of ESA and still can`t brush away the mental stress of knowing I could be put through the same regime again soon.
