I don`t see Scotland mentioned on this document? Maybe I rushed through some of the reading but I do know that the Scottish government have (or will be) introducing two programmes in Scotland from April to `mitigate` the Westminster training programmes, so I`m wondering if these `Work Choice` and `Work Able` programmes will be the Scottish equivalent?

So looks like this H&W programme won`t be in Scotland. Bloody hope not as I can see the old work programme looming with the word `health` added.

What the F is this Work and Health Programme (WHP) . Is it mandatory ? not read it all but it says you on it for over 400 days.
whos gonna do it ? will you have to go somewhere for all these days ? Have we still got our rights to stop them having our data ?
Anyone know anything ? We used to get all the answers here but nothing off anyone .
Anyone know anywhere else to go for legal information on what we can do to protect our data without getting sanctioned on the first day ?

I`m sure there will be more than a few data protection flaws we can use as we used to do with the original work programme. This one is no different as only the word `health` has been added, it seems.

To be honest comply my limited knowledge only extends to my neck of the woods, I have no idea how Scotland works with benefits.

All these programmes are the same, useful if you want their services if only to beat loneliness and a day out, if you do not want their support then they are nothing more than a punitive measure.

I have found a change that gives them the edge in regards to the data protection act, I tend to go over lots and lots of material without taking notes then I have to back track to find the information, it is out there just forgot what FOI it was, doh, it did strike me at the time why they did not use it to close the hole in the previous work programme this time I noticed they closed that hole, I will find it and post it as soon as.

That`s a good way to look at it dboy. As for giving consent....it`s one of those grey areas where they will tell you that you MUST sign the forms in order for them to be able to comply with their mandate and to protect your data by the law/regulations laid down by DWP. If we DON`T sign, it doesn`t mean we can`t withdraw the consent at a later date, but could provide them with an excuse to make attending as difficult as possible. So for someone like me who has disabling pain that suits itself when it wants to make my day a misery, I would make sure that the provider knew this and that I would be participating on a voluntary basis only because of this and would ask to sign something agreeing to this, so that if I couldn`t go in, I wouldn`t be sanctioned for non attendance. If they refused, I would ask my GP to provide me with fit notes stating I could not take part due to significant pain.

Given this programme is designed for disabled people and people with health problems and also those who are further from the jobs market due to their age or just have not been able to find a job, I would start by making sure your rights are in place and make sure you know what you are signing up for because when you read the above links, it`s clear that these providers are set in place to use the same old tactics as before.

Warning Blowing my trumpet
As a veteran from the Work programme I was involved in a epic battle.

I used every piece of law to fight back and tie them in knots, this made a rod for my back they were determined to break me, but the more they pushed, the more I pushed back, making sure I gave them no grounds to sanction me in the end there was very little they could make me do.

My adviser was totally ignorant most of the time I had to point out where the letter mandating me to do this or that was not formatted, worded correctly,did not make sense to me so it would not stand up,he would then struggle to word what it was he exactly wanted me to do by the time he had settled on something he would say forget that do this.

He did not believe me when I told him I was allowed to not consent to having my data shared to third parties, that I did not have to give him my Email Address, Telephone number, that I did not have to do 35 hours job search per week, only 3 or more steps per week less in some circumstances , he did not believe me when I told him every step he asked me to do counted towards those steps.he could not look at my personal correspondence ,tried to buy me a bike lool, the list was endless I just saved up all my complaints and sent them to his head office in one go.

He would say you could lose your home if your not careful, did not believe me when I told him my housing benefit is not subject to sanctions, my daughter had her HB stopped after a sanction, yeh I said because she failed to inform them of the changes, lol
I let him dig his own hole bulit up a list of complaintss and fired them off in one go.

They upheld all my complaints, confirmed everything I had been saying regarding data and privacy,rent etc and apologised.
I had 3 months left to go on the Work programme and never heard a peep from them to this day year on, no exit report, no uncomfortable interview with JCP it is as though I were never on it, no mention at all.

My adviser clearly did not want to face me and have to apologise to my face and accept he was wrong all along,surprised though he did not write me a damning exit report I can only presume he might have left before my sentence ended and so no one was available to do the report.

I resist anything that needs my consent or not unless I agree, I am not a commodity.

I recently got chucked off group signing at another office because I openly disagreed with the work coach when she tried to remind everyone we had to do 35 hour job search and at every opportunity told my fellow cohorts what they can do to fight back, they are puzzled at the other office why I returned after being sent to the other office, my CC has vanished My digital signature has also from the system and this month they are moving being rolled into one super office at the council so even more chance to keep slipping through the cracks.

The Job centre plus is in chaos at the moment, they are having to work with UC and legacy benefits,lack of staff and training, the IT systems are struggling to cope,the work coach and work coach assistants are at the front line having to police people who are clearly physically or mentally unable to cope or work and must have an effect on them day in day out,they are human beings and yes some are not.

I have been signing on for many years you would rarely see anyone ill, nowadays the JCP looks more like a accident and emergency ward.
