Could this be used as a way to avoid workfare schemes? If a provider can't guarantee a claimant's safety, then that could be used as a way to refuse taking part in such schemes--maybe.

I’m surprised no one has responded to this. It looks like a potential loophole to avoiding work schemes on health and safety grounds.

This is a valid point archangel because some providers may say they are doing these checks, but won`t reveal they are standard checks rather than digging deeper. Even people working in the voluntary sector with `vulnerable` people need to have a DBS done along with photo ID. The organisation usually pay for this to be done but it varies. I met with a voluntary organisation last year about the home library service and the woman I met told me that these checks are carried out and that she would be taking my actual photograph if I went ahead with it, or I could provide one myself. I didn`t proceed with that volunteering and went somewhere else where I was better placed, but I`m not a volunteer there so didn`t need any checks carried out. Had I went down the route of becoming a volunteer there though, this would have been done.

Is there any way that we could ask to see proof of criminal checks having been done before we agree to go on a work scheme?

This is particularly important for women to know, in case of risks of sexual harassment or inappropriate sexual behaviour by work scheme staff?

But unless providers can produce evidence that they are doing these checks correctly, we should be able to ask them to show evidence of the checks they have carried out on their staff but need to know how to do that under some right of access law?

Archangel, this is an important issue that doesn’t get anywhere near the attention it deserves.

Health and safety issues, insurance cover and checks on work experience providers and their staff have been a cause for concern for many years.

Claimants have used those concerns to question mandatory referral to placements with providers who could not provide the assurances that they are required by law to provide.

The problem has been that the vast majority of claimants sign away their rights without giving it a second thought, thinking; ‘I’ll sign anything without question for a quiet life’.

Just out of interest have you had any experience of being sent on any sort of work experience course?

No but I know people who have. They don't even think about the issue.

I think if we can find a way to use this to put a spanner in the works so that we don't have to go on them it would be good.

These days accusations of sexual misconduct or the threat of it is given a lot of attention by the law. it would put the fear of God in work providers if we let them know we were conscious of this.

So true! its this we all need to concentrate on when sitting in one of their 'offices,'question everything we possibly can and all the time having the correct answer for them :)

People are going to be seriously pissed off at having to attend this MKII circus they call the "WHP" and this time i feel it wont be very easy sailing for these provider companies. :evil:

Maybe an FOI request could come up with this info Comply ?

After all we are all members of the public and need to be legally covered by insurance when being forced against our free will to attend these scummy places and are sure it will be in the public interest, as they may one day be joining us all on these wonderful educational day outs. :whistle:
